Question:
“I’m buying a house and we’re closing in 3 days. There’s a nice detached building in the back that I’ll use as an office. But the neighbor just said it’s built too close to his property line and he’s going to report it. All my contingencies are released. Since this is a new disclosure, my agent said I have 3 days to decide if I want the house. But I do want it. Can I make the seller credit me for the cost of moving it, probably a few $1000s?
Answer:
Sorry to hear about your situation.
First of all, although this is new information for you as a buyer, it’s not a new disclosure from the seller. So contrary to what your agent said, you don’t have any new rights to disapprove or decide if you want the house.
You could have recourse if you can prove that the seller knew about it and didn’t tell you. But first, reread the disclosures to see if they did. If they did, you wouldn’t have any recourse.
Either way, you could always give it a shot and ask for a credit now and see what they say. They probably won’t be happy and you don’t have a leg to stand on (unless the seller knew), so don’t expect anything.
Also, please consult with a real estate attorney.
