Question:
“The seller’s agent texted my agent that our offer on a home was accepted, but now they say they sold the home to someone else. Is that legal?”
Answer:
For a real estate contract to be accepted and binding, there must be:
- A written offer
- Written acceptance
- Delivery of written acceptance to the party designated in the offer to acknowledge acceptance
I’m assuming you and perhaps your agent were the parties authorized to acknowledge acceptance.
So unfortunately in your case, the text did not constitute proper delivery as you did not actually receive the seller’s written acceptance.
I’m not a lawyer, although I play one on TV,* so please seek the advice of an attorney.
