State law requires that a landlord with a month-to-month tenant generally must give a 60-day notice to terminate tenancy if the tenant has lived there for one year or more.
However, an owner selling a rental may give a 30-day notice if ALL the following conditions are met (per statute):
- Owner has signed a contract to sell the property “to a bona fide purchaser for value”;
- The owner has established an escrow with a licensed escrow officer or real estate broker;
- The buyer is a “natural person(s)”;
- The buyer in good faith intends to live in the property for at least one year after termination of the tenancy;
- The termination notice is given within 120 days of opening escrow;
- Notice has not previously been given to the tenant under this law;
- The dwelling is alienable separate from the title to any other dwelling unit.
Note: other rules apply if a tenant has not paid their rent or otherwise broken their rental agreement.
